Data Protection Policy

This information is provided, in compliance with Articles 13 and 14 of the EU Regulation 679/2016 (hereinafter: "Regulation"), to the users (hereinafter: "Users" or "User") of the website https://www.batmaid.de/ and of any mobile application related to it (hereinafter: "Site and App"), owned by Batmaid  Germany GmbH, the Data Controller (hereinafter: "Data Controller"), and aims at describing the management modalities of the Site and App with reference to the processing of personal data, as well as to allow the Users of the Site and App to know the purposes and modalities of the processing of personal data by the Data Controller in case of their conferral.

As specified in the Terms and Conditions of Contract, the services offered by the Owner are intended for people over 18 years old. Should the Controller become aware of the processing of data of minors under the age of 18 without the valid consent of their parents or legal guardian, the Controller reserves the right to unilaterally terminate the use of the service offered and to delete the data acquired.

Terms that are not defined in this Data Protection Notice have the same meaning as described in the Terms and Conditions.

PRINCIPLES APPLICABLE TO THE PROCESSING OF PERSONAL DATA

The Data Controller, pursuant to and for the purposes of the Regulations, informs you that the aforementioned legislation provides for the protection of individuals with regard to the processing of personal data, and that such processing will be based on the principles of correctness, lawfulness, transparency and protection of confidentiality and fundamental rights.

DEFINITIONS AND OBJECT OF PROCESSING

In relation to the use of the Site and the App, the following categories of Users are distinguished:

Client: refers to any natural or legal person who uses the Platform to benefit from a Service.

Agent: refers to an employee of Batmaid Germany GmbH.

The personal data necessary for Customer Registration and subject to processing are:

Batmaid collects data relating to Users when they register on the Website or App and in the following circumstances:

when the User visits the Website;

when the User books a cleaning service through the Website or by phone;

when User makes a complaint to our customer service department;

when User receives marketing information about our services and products;

when User participates in any promotion or market research survey;

when User uses or communicates with Batmaid or an agent through the Website;

when User voluntarily provides information online;

by telephone, recorded telephone calls, email communications, interviews with the Batmaid team;

through the use or viewing of our Website via the cookies of the User's browser;

through third party websites, provided that User has already consented to the sharing of the data User has provided on such websites.

PURPOSE OF TREATMENT

Batmaid collects User data for the following purposes:

provide a cleaning service and manage the booking account;

help the User access their account efficiently;

remember the User's information so that the User does not have to re-enter it during navigation or when visiting the Website again;

to deliver the cleaning products purchased on Batmaid.de.;

for possible statistical and data analysis purposes without personal re-identification.

Furthermore, Batmaid collects your data for marketing purposes. More specifically, Batmaid wishes to send you information on certain Batmaid products and services that it believes you may find useful. If you do not wish to receive marketing related emails from Batmaid, you have the right to request not to be contacted for marketing purposes at any time. If you have agreed to receive marketing related emails you can unsubscribe at any time. In cases where you do not wish to be contacted for marketing purposes, simply send an email to Batmaid at the following address: kunde@batmaid.de.

METHODS OF PROCESSING AND STORAGE OF PERSONAL DATA

The Data Controller ensures that personal data are processed in full compliance with the Regulations, in paper and/or electronic format, also with the aid of automated procedures. The processing may also be carried out by means of automated tools designed to store, manage and transmit the data.

The data collected and processed will be protected with physical and logical methods such as to minimise the risks of unauthorised access, dissemination, loss and destruction of data, pursuant to Articles 25 and 32 of the Regulation.

In particular, the User's data will be stored on the Swiss company Exoscale and on Amazon's servers, which guarantees compliance with high-security storage requirements.

The processing of the data will last no longer than is necessary to fulfil the purposes for which they were collected.

Pursuant to art. 7 paragraph 3 of the Regulations, the interested party will have the right at any time and in an easy and fast way to revoke consent to the processing and request the cancellation of their personal data, by sending a communication to the Data Controller.

Following the User's request for cancellation, all of his or her personal data will be deleted, without prejudice to any further storage required by law. Furthermore, if the User has been recalled, suspended or sanctioned for fraudulent or suspicious behaviour, or if a User has requested a cancellation after publishing a request or a review, the Data Controller reserves the right to retain personal data relating to that User for a period of 2 (two) years from the cancellation request, in order to prevent the occurrence and/or recurrence of any fraud to the detriment of the Company itself (Data Controller).

If the data manager does not receive a request for deletion, the personal data will be kept for a maximum period of 3 years, starting from the date of the user's last access to the website and/or the app, unless they are tax documents, which must be kept for 10 years in accordance with Section 146 (1) sentence 1 UstG, or commercial and business letters, which must be kept for 6 years in accordance with Section 257 (1) no. 1, 3 (4) BGB.

 

DATA TRANSFER

The management and storage of personal data will take place in Europe, on servers located in Germany of the Data Controller and/or third party companies also abroad, appointed and duly appointed as Data Processors for the use of the services requested. The personal data provided may be transferred abroad within and outside the European Union, within the limits and under the conditions set out in Articles 44 et seq. of EU Regulation 2016/679, in order to comply with purposes related to the transfer itself.

COLLECTION OF NAVIGATION DATA

The computer systems and the technical and software procedures underlying the operation of the Website and the App acquire, in the course of their normal operation, certain personal data whose transmission is implicit in the access and operation mechanisms and protocols in use on the Internet.

Every time the User connects to the Website and the App and every time he calls up or requests content, access data is stored on our systems in the form of tabular or linear data files.

This category of data includes, for example, IP addresses, the domain names of the computers used by the Users who connect to the Website and the App, the request from the User's browser in the form of URI (Uniform Resource Identifier) addresses, the date and time of the request to the server, the method used to submit the request to the server, the amount of data transmitted, the numerical code indicating the status of the response given by the server and other parameters relating to the User's operating system and computer environment.

This data may be used by the Data Controller in order to obtain anonymous statistical information on the use of the Site and the App in order to identify the pages preferred by the Users and thus provide increasingly adequate content and to check that they are functioning correctly. They may also be used, subject to the explicit consent of the User, to send communications and reminders (e.g. requests for telephone contact).

Upon request of the Authority, the data could be used to ascertain responsibility in case of hypothetical computer crimes against the Site and App or its Users.

COOKIES INFORMATION

Cookies are small files that are downloaded to your device when you visit a website. The cookies then send the data back to the website from which they originated on each subsequent visit or to another website that recognises these cookies. Cookies allow a website to recognise the User's device. 

The User can find more information on cookies at: https://www.google.com/policies/technologies/cookies. The information collected by Batmaid's cookies is processed on servers located in Switzerland and in Europe. European Union (EU) Users have the right to refuse the placement of cookies on the device they have used to access the Website. These are most often referred to as third party cookies. These are cookies deposited by third-party companies (such as advertising agencies or partners) to identify your centres of interest through the products and services consulted or purchased on our site and to personalise the advertising offer that is sent to you on or off our site.

By way of illustration, when you browse our site, Google may install cookies from our site to identify your browser and device for marketing or behavioural analysis purposes.

They may be deposited while you are browsing our site or when you click on advertising areas of our site.

We ensure that all of our partners process your personal data in accordance with applicable laws and regulations and we are committed to implementing appropriate technical and organisational measures to best protect the confidentiality, integrity and availability of your data.

TYPES OF COOKIES USED

There are different types of cookies, however, the batmaid.de. website uses the following:

Functional: We use these cookies to recognise the User on our website and to remember preferences previously selected by the User. These may include the User's language preference and geographical location. A combination of first party and third party cookies are used. Cookies allow for smooth navigation between pages and improve your overall experience. For example, cookies remember that the User is logged in and avoid the need to re-enter contact information.

Analytical: Cookies are also used for analytical purposes but remain anonymous. Batmaid can cite an example of the use of cookies for audience measurement and statistics relating to television campaigns. The Realytics cookie is committed to respecting the data collected and does not collect any personal or sensitive data and can be deactivated from the Realytics deactivation page at the following address: https://www.realytics.io/optout/.

SessionCam: Batmaid uses SessionCam to analyse how users interact with websites and the content on them. Mouse movements, mouse clicks, page scrolling, text entered in search boxes and forms on the website may be recorded for statistical reporting purposes and to improve the usability of the website. The data compiled is for internal use only and does not involve any sensitive personal information.

Trustpilot: Batmaid may contact the User by email to invite him/her to review any services and/or products received in order to collect feedback and improve services. Batmaid uses an external company, Trustpilot A/S ("Trustpilot"), to collect User feedback, which means that Batmaid will share the name, email address and reference number of the User with Trustpilot for this purpose. Social plugins: The Website uses social plugins, for example from Facebook, Twitter or Google+. The plugins are marked with the provider's logo and may be, for example, a "Like" button or a Google+ button or a Twitter button. When the user calls up the website containing such a plugin, the user's browser establishes a direct connection with the provider's computers. The content of the plugin is transmitted from the provider's website directly to the User's browser, which integrates it into the website. By integrating the plugins, the provider receives information that the User has called up our website. If the User is simultaneously connected to the provider, the provider can assign the visit to the profile. If the user interacts with the plugins, for example by activating the "Like" button or making a comment, the relevant information is transmitted from the user's browser directly to the provider and stored there. If the User does not want the Provider to collect data about him via the website, the User must log out of the Provider's website before visiting the batmaid.co.uk website. Even if the User is logged out, the Provider collects anonymised data through social plug-ins and sets cookies for the User. If the User subsequently logs in to the provider, this data can be assigned to the User's profile. If an ID is provided via a social login service, e.g. Facebook Connect, the data is exchanged between the provider and the website. In the case of Facebook Connect, this can be, for example, the data from the user's public Facebook profile. By using such login services, the user consents to the transfer of the data. 

The user should consult the provider's data protection notices for the purpose and scope of data collection and further processing of the user's data by the provider, as well as the respective rights and setting options to protect his or her privacy. If the User does not want the provider to collect data about him through these cookies, the User can select the "block cookies from third-party providers" function in his browser settings. Thus, if there is content embedded by other providers, the browser will not send any cookies to the server. It is possible that with this setting, other functions of the website will no longer function.

COOKIE MANAGEMENT

The User can set his or her own non-acceptance of cookies. However, in some cases, some functions of the website may not function accordingly

RIGHTS OF THE INTERESTED PARTY

Pursuant to Articles 15 to 22 of the Regulation, the User, as a data subject, is entitled to exercise specific rights concerning his/her personal data. In particular, the Data Subject has the right to obtain:

a)   request confirmation of the existence or otherwise of his/her personal data;

b)  obtain information about the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be communicated and, when possible, the storage period;

c) obtain the rectification and erasure of data;

d) obtain the restriction of processing;

e) obtain the portability of the data, i.e. receive them from a data controller, in a structured, commonly used and machine-readable format, and transmit them to another data controller without hindrance;

f)   to object to the processing at any time and also in the case of processing for direct marketing purposes;

g)  to object to an automated decision-making process concerning fixed persons, including profiling.

h)  request from the data controller access to and rectification or erasure of personal data or restriction of processing concerning him or her, as well as the right to data portability;

i)   revoke consent at any time without affecting the lawfulness of the processing based on the consent given before revocation;

j)    to lodge a complaint with a supervisory authority. The complaint can be submitted to the data protection supervisory authority responsible for us, namely the Berlin Commissioner for Data Protection and Freedom of Information, Friedrichstraße 219, 10969 Berlin, email: mailbox@datenschutz-berlin.de.

The User may at any time request the cancellation of his Profile by writing to: kunde@batmaid.de.

Location data privacy policy (only applicable to Batmaid cleaning staff)

In order to ensure the wellbeing and correct compensation of our cleaning personnel we are recording the location of the device used for starting and finishing each cleaning. This data is only recorded after explicit consent from the user and only when the user triggers the action of starting or finishing the cleaning. The data is stored separately from any PII and only used in the context of calculating compensation for time worked and operational management of ongoing cleanings.

CHANGES

This policy may be subject to change. In order to keep the User up to date, the Controller invites him/her to visit this page periodically. In addition, if such changes have an impact on the data relating to the User (for example, if the Data Controller intends to process the User's personal data for purposes other than those previously communicated in this Policy), the Data Controller will inform the User before such changes take effect by posting them as prominently as possible on its Site and App.
